Controller and applicable law

The personal data controller is SIA "RMauto", reg. No. 44103121489, registered address: "Sauleskalni", Daukstu pag., Gulbenes nov., LV-4429 (the Company).

Applicable law: Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation); the Latvian Personal Data Processing Law.

1. What is the Privacy policy?

1.1. This Privacy policy (the Policy) explains how the Company collects, processes, stores, shares, deletes and protects the Customer's personal data so that it is processed lawfully, fairly and transparently.

1.2. The Company may amend and update this Policy. The current version is always available at autokvartals.414.lv.

2. How to contact the Company?

2.1. The Customer may contact the Company at any time for information about the processing of their personal data:

3. What personal data does the Company process?

3.1. The Company processes the following personal data:

3.1.1. name, surname, phone number and email address provided by the Customer when contacting the Company or submitting an application;

3.1.2. data given in the financing application: personal code, declared address, marital status, number of dependants, education, employer, position, length of employment, type and amount of income, other credit commitments, whether the Customer is a politically exposed person, and the requested financing amount and term;

3.1.3. information about the vehicle the Customer is interested in or is applying to finance;

3.1.4. technical data about website visits and, if the Customer has consented, cookie data.

4. What is the legal basis for processing?

4.1. Consent: the Customer consents to the processing of their data for specific purposes and may withdraw consent at any time. Withdrawal does not affect processing carried out before it.

4.2. Entering into and performing a contract: to prepare and perform a contract with the Customer, the Company needs to process the necessary data.

4.3. Legitimate interests of the Company: providing quality services and timely support to the Customer to the extent objectively necessary.

4.4. Legal obligations: to comply with legal requirements and respond to lawful requests from public authorities.

5. What are the purposes of processing?

5.1. The Company processes the Customer's personal data to:

5.1.1. answer the Customer's questions and communicate about vehicles;

5.1.2. prepare and send the Customer's financing application so the Customer can receive a financing offer;

5.1.3. conclude and perform a vehicle purchase contract;

5.1.4. handle the Customer's complaints and improve the Company's services.

6. Who may the Company share the Customer's personal data with?

6.1. To provide the service, the Company may share the Customer's personal data with:

6.1.1. SIA "MONGO", reg. No. 40203723428 (credit intermediary licence No. KS-39), which as a licensed credit intermediary prepares and sends the Customer's financing application to lenders;

6.1.2. lenders (banks, leasing and credit companies), only to the extent needed to review the application;

6.1.3. IT, hosting and other service providers that run the website on the Company's behalf;

6.1.4. courts, law enforcement and other public authorities where required by law.

6.2. The Company shares only the data that is needed and never shares personal data with third parties without a legal basis.

7. Cooperation with a credit intermediary

7.1. The Company does not issue loans and is not a credit intermediary. Financing applications are prepared and sent to lenders by SIA "MONGO", reg. No. 40203723428, which holds credit intermediary licence No. KS-39.

7.2. When a financing application is submitted, the Customer's data is passed to SIA "MONGO", which processes it as a controller under its own privacy policy. The final decision on financing is made, and the contract concluded, by the relevant lender.

7.3. The Company does not store the personal code, income or other application data itself: the website keeps only the Customer's name, contact details and the requested amount so the Company can contact the Customer.

8. How long does the Company keep personal data?

The Company keeps the Customer's personal data as long as needed for the purposes in this Policy, while the Customer's consent is valid, or as long as the law requires. After that the data is deleted or anonymised.

9. Cookies

The website uses necessary cookies and similar technologies and, if the Customer has consented, analytics and marketing cookies. More details are in the Cookies section.

10. How does the Company protect personal data?

The Company uses technical and organisational measures to protect personal data from unauthorised access, loss, disclosure or destruction. Data between the Customer's browser and the website is transmitted encrypted.

11. What are the Customer's rights?

The Customer has the right to request access to their personal data, its correction, deletion or restriction of processing, to object to processing and to request data portability, insofar as processing does not result from the Company's legal obligations.

A request can be made in writing by sending it to info@autokvartals.lv. The Company will verify the Customer's identity and reply within the time limit set by law.
